Terms of Service
Last updated 8 November 2026
These terms apply when you use the Upfront Kiwi website, run a free Website Health Check, or buy a website, fix or care plan from us. By buying from us or using our services, you agree to these terms. "We" and "us" means Upfront Kiwi, New Zealand. "You" means the business or person using our services.
1. Our services
- Website packages: Starter ($499), Business ($999) and Bookings & Shop ($1,799), each with the features, rounds of changes and delivery time shown on our website when you buy.
- Fixes: improvements to an existing website, chosen from your Health Check results.
- Hosting & care plans: monthly plans for hosting, security and edits, as described on our website.
- Website Health Check: a free, automated report on a public website.
Larger or more complex websites are priced by written quote. A quote is valid for 30 days.
2. Prices and payment
- All prices are in New Zealand dollars. We aren't registered for GST, so the price shown is the full price.
- One-off packages and fixes are paid in full at checkout. Payments are processed securely by Stripe.
- Monthly plans are charged automatically each month to the card you give us.
3. Delivery times
Delivery times are working days (Monday to Friday, excluding New Zealand public holidays). They start when your onboarding form is complete, with your content, photos and the access we need. If we're waiting on you for content, approvals or access, the clock pauses until we have them.
4. Changes and revisions
Each package includes the number of change rounds listed for it. A round is one set of feedback sent together. Requests outside the agreed scope, such as new pages or features, are quoted separately before we do them.
5. Pay-monthly websites
The pay-monthly Business option is $129 a month for a minimum of 12 months, including hosting and care. After 12 payments it becomes $39 a month for hosting & care. If you end it before 12 payments, you can pay the rest of the 12 monthly payments and keep the site, or we can take the site offline. Your domain and your content stay yours either way.
6. Hosting & care plans
You can cancel a hosting & care plan at any time by emailing [email protected]. It ends at the end of the month you've paid for, and we don't charge again. Unused edit time doesn't carry over. If a payment fails and isn't fixed within 14 days, we may pause the plan. If you leave, we'll help you move your site to another host.
7. Refunds
- If you change your mind before we start work, we'll refund you in full.
- Once work has started, we'll refund any part of the price for work we haven't done yet.
- If we can't deliver what we promised, we'll fix it or refund you.
8. Your content and responsibilities
You confirm that you own, or have permission to use, the words, photos, logos and other material you give us, and that they're accurate and lawful. You're responsible for the information on your website, including prices, opening hours and claims about your business. You'll keep any logins you share with us safe and tell us if they change.
9. Ownership
Your domain is registered in your name. Once your package is paid in full, you own your website's content and design. We keep the right to reuse our general templates, code and know-how, and to show your site in our portfolio unless you ask us not to. Third-party tools, themes and plugins stay under their own licences.
10. Website Health Check
The Health Check is free, automated and for general information only. It reads publicly available pages and may not catch every issue. Only check websites that you own or have permission to check. We limit how many checks can be run, to prevent misuse.
11. No guarantees about rankings
We build websites to follow search engine and accessibility best practice, but no one can guarantee a particular Google ranking, amount of traffic, or number of sales or enquiries. Third-party services such as Google, domain registrars and payment providers are outside our control.
12. Liability
Our services are supplied and acquired for business purposes. As allowed by section 43 of the Consumer Guarantees Act 1993 and section 5D of the Fair Trading Act 1986, the Consumer Guarantees Act doesn't apply and the parties agree it is fair and reasonable to contract out of those sections of the Fair Trading Act. As far as the law allows, we aren't liable for indirect loss, such as lost profits or lost data. Our total liability to you is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits any rights that can't be excluded by law.
13. Privacy
Our Privacy Policy explains how we handle personal information.
14. Changes to these terms
We may update these terms. The version on this page when you buy applies to that purchase. For monthly plans, we'll email you before any change that affects you takes effect.
15. Law and disputes
These terms are governed by New Zealand law. If something goes wrong, email [email protected] and we'll work with you to sort it out.
